達美航空AI服務條款

本《AI服務條款》（以下簡稱「AI條款」）適用於您在使用達美航空公司透過其網站和行動應用程式提供的生成式AI工具與功能（例如聊天機器人和AI驅動的搜尋功能）及其他相關技術（以下統稱為「AI工具」）時的行為。 本《AI條款》是您與美國達美航空公司（以下稱「達美航空」、「我們」或「本公司」）之間具有法律約束力的協議。 By using the AI Tools and the information, content, tools, products and services on our websites and mobile apps (collectively, the “Service” or “Services”), you acknowledge that you have read, understood, and agree to be bound by these AI Terms, the Terms of Use and any other applicable terms and policies.

1. Your Commitments

A. 資格條件

在不限制《使用規則》或任何其他適用條款或政策的前提下，AI工具不適用於以下用戶：(i) 年齡未滿16歲者，或 (ii) 根據適用法律被禁止接收或使用我們服務的使用者。

B. 禁止用途

您不得以以下方式使用或允許他人使用AI工具或服務的任何部分：

  • 修改、複製、分發、傳輸、展示、發佈、銷售、授權、創作衍生作品，或將服務或我們的智慧財產用於商業或公開目的，除非本《AI條款》及《使用規則》明確允許。
  • 在其他網站或網路環境中重新發佈、重新分發或框架化服務內容。
  • 拆解、反向工程或反編譯服務的任何部分。
  • 使用自動化工具（如機器人或爬蟲）以超載我們的伺服器的方式使用服務。
  • 將服務內容用於AI訓練或辨識個人身份。
  • 以影響服務的穩定性、性能或其他使用者的方式使用服務。
  • 採取對我們基礎設施造成不合理負擔的行動。
  • 將服務用於非法、詐欺或有害的目的。
  • 使用服務與我們競爭，或開發競爭性產品。
  • 透過未經授權的方式使用服務。
  • 規避我們的安全保護措施。
  • 干擾服務的安全性或完整性。
  • 透過服務發送垃圾郵件、惡意代碼或病毒。
  • 假冒他人身份或隱藏您的身份。
  • 從服務中收集個人資訊。
  • 未經授權暗示獲得我們的支持或具備關聯性。
  • 將服務的輸出結果聲稱為真人生成（若事實並非如此）。

2. 提示、結果與其他內容

A. Rights to Content

AI工具可能允許您提供用於處理的素材，這些素材可能包括文字、文件、圖像或錄音，具體取決於整合方式（統稱為「提示」）。AI工具將根據您的提示生成回應（亦即「輸出內容」）。 提示與結果，加上您提供的任何意見回饋（簡稱「回饋」），統稱為您的「內容」。 您不得提供提示或以任何侵犯或違反他人權利（包括智慧財產權）的方式使用AI工具。 除本《AI條款》明確規定外，您保留對提示所擁有的所有權利、所有權及利益，包括任何智慧財產權。 您同意，您提供的提示不得違反本《AI條款》及適用於AI工具之使用的其他政策，我們可能會隨時補充、更新或修訂這些政策。

達美航空可使用您的內容及相關資訊，並可能透過自動化、人工（真人）審查，以及在某些情況下透過第三方供應商進行處理，包括以下用途：

  • 提供、維護及改進服務、AI工具及我們的其他服務與功能，包括訓練人工智慧模型及機器學習演算法；
  • 進行及支持研究；
  • 監控您對AI工具的使用是否符合本《AI條款》及適用法律，並在法律要求的情況下回報違反適用法律或法規的行為；
  • 移除不安全、具歧視性或其他違反本《AI條款》或任何其他適用政策與條款的內容；以及
  • 暫停、封鎖或移除違反本《AI條款》的使用者或帳戶。

B. Personal Information

達美航空的《隱私政策》規範了我們透過AI工具收集的個人資料的處理方式，並說明我們如何收集、使用及分享個人資料，包括您作為提示、回饋或其他內容提交的個人資料、您在我們產品中的活動，以及我們從您的裝置中收集的個人資料和相關資訊。 

C. 第三方連結

輸出內容可能會包含通往非達美航空經營或控制的其他網站的連結。 To the maximum extent permitted by law, we are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored, or checked for accuracy or completeness by us. 請記住，當您透過AI工具中的連結進入其他網站時，本本《AI條款》將不再適用。 您在任何其他網站上的瀏覽與互動行為（包括我們服務中包含連結的網站），均受該網站自身的規則與政策約束。 此類第三方可能會使用其自有的Cookie或其他方式收集您的資訊。 You acknowledge and agree that, to the maximum extent permitted by law, Delta shall not be responsible for any third-party links, content, or other services (“Third Party Services”), including their accuracy, completeness, timeliness, validity, accessibility, copyright compliance, legality, decency, quality, or any other aspect thereof. 達美航空不對您或任何其他個人或實體就任何第三方服務承擔任何責任或義務。 第三方服務、其內容及相關連結僅為方便您而提供，您對上述項目的存取和使用完全由您自行承擔風險，並受該第三方的規則與條款約束。

D. 暫停與終止

若我們認定您違反了本《AI條款》、《使用規則》或其他適用的條款與政策，我們可能暫停、封鎖或永久停用您對AI工具、服務及其他達美航空服務或功能的存取權限。此外，我們可能會永久停用或刪除您的帳戶，包括在法律要求的情況下執行此類操作。

3. 第三方素材

AI工具會使用多種來源來回答問題，包括但不限於delta.com官網、Visa Run Inc.（以「Sherpa」的名義經營）以及國際航空運輸協會（IATA）。 Although Delta, Sherpa, and IATA make reasonable efforts to provide accurate information, they cannot guarantee and make no representation or warranties about the accuracy of, and accept no liability for, information about travel restrictions or visa and entry requirements. To the maximum extent permitted by law, Delta is not responsible for any goods or services offered by Sherpa or other providers.

4. 服務的更新與中止

達美航空可能不時強化或改進AI工具的功能與特性，包括修補程式、修復漏洞、更新、升級及其他修改（以下統稱為「更新內容」）。 更新內容可能會修改或刪除AI工具的某些功能和／或特性。 達美航空沒有義務 (i) 提供任何更新內容，或 (ii) 持續向您提供或啟用AI工具的任何特定功能和／或特性。 所有更新內容將被視為AI工具的完整部分，並受本《AI條款》約束。 達美航空保留隨時中止提供AI工具的權利。 Prior notice shall be given if Delta discontinues the AI Tools.

5. AI工具的所有權

我們保留對AI工具的所有相關權利、所有權及利益，包括其智慧財產權。 除本《AI條款》中明確授予您存取和使用的權利外，本本《AI條款》並未授予您對AI工具的任何權利、所有權或利益。

6. 免責聲明及責任限制

Our AI tools are provided free of charge. To the maximum extent permitted by law, we do not guarantee that the Services or any part or function, including without limitation any transactional function, will be available and not subject to interruption at any time. We may suspend or withdraw or restrict the availability of all or any part of an AI Tool for business and operational reasons. We do not guarantee that any Service or function, including without limitation any downloadable files available on the Delta websites or mobile apps, is free of computer viruses, malware or other destructive or harmful programs, software, code or devices that may erase, scramble, lock or disable any computer software, content or equipment or may prevent users from using a site or any other item of hardware or software. 您應定期掃描您的系統及下載的檔案，以檢測此類有害裝置。

AI工具提供的回應為人工生成，可能包含不準確的內容。 To the fullest extent permitted by law, Delta: (i) provides the AI Tools on an “AS IS” and “AS AVAILABLE” basis, (ii) does not give any warranties and disclaims all responsibility for any inaccuracies in Outputs and (iii) makes no guarantees that use of the AI Tools will be safe, secure, or error-free, or will function without disruptions, delays, or imperfections. 您不應僅依賴AI工具提供的回應。 If the AI Tool is unable to answer your question, the information provided by the AI Tools conflicts with other official information, or you require further assistance, you may contact a Delta Reservations specialist.

準確性

AI將根據您提供的提示生成輸出內容。 AI工具根據您的提示所提供的具體輸出內容無法事先預測。 AI工具可能生成您認為具冒犯性、令人反感的內容，和／或不代表達美航空立場的內容。 透過同意本《AI條款》並使用AI工具，您理解並承擔因您提供的提示可能導致生成您認為具冒犯性或令人反感的內容的風險。 YOU ALSO RECOGNIZE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU – NOT DELTA – ARE RESPONSIBLE FOR YOUR USE OF, AND ANY ACTIONS YOU TAKE IN RELATION TO, OUTPUT GENERATED BY THE AI TOOLS BASED ON YOUR PROMPTS.

責任限制

達美航空的責任將在適用法律允許的最大範圍內受到限制。且在任何情況下，我們均不對因本《AI條款》或AI工具引起或與之相關的任何利潤損失、收入損失、資訊或數據損失，或任何間接性、特殊性、附帶性、懲罰性或示範性損害承擔任何責任（無論損害如何產生，基於何種責任理論，包括過失），即使達美航空已被告知可能發生此類損害。

賠償

To the maximum extent permitted by law, you agree to indemnify and hold Delta and its subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from and against any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) 您對AI工具的使用；(b) 您違反本《AI條款》或任何法律或法規；或 (c) 您侵犯任何第三方的權利。

Jurisdiction-Specific Limitations

Certain jurisdictions do not permit the exclusion of specific warranties or the limitation of certain liabilities. As a result, some provisions outlined in Section 2C (Third Party Links), Section 3 (Third Party Content) and this Section 6 (Disclaimer of Warranties and Limitations on Liability) may not apply to you, and you may be entitled to additional rights under applicable law. In such cases, these AI Terms shall limit Delta’s liability and obligations only to the extent legally permissible in your country of residence.

7. 舉報濫用、錯誤或非預期的輸出內容

8. 可分割性

If any portion of these AI Terms is found to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it cannot be made enforceable, then it will be severed and the remaining portion will remain in full force and effect unless it is impossible to achieve the purpose of the AI Terms with only the remaining enforceable portions. 我們未能執行本《AI條款》中的任何條款，不得視為放棄該條款的權利。 任何對本《AI條款》的修訂或放棄，均必須以書面形式作出並由我們簽署。

9. AI條款的變更

Please download them for your records, future reference, and to ensure identical reproduction of its content. It is essential that you retain a copy of these AI Terms for your personal documentation purposes.
